Stationary trainings terms and conditions

§1
GENERAL PROVISIONS

1. These Regulations for Stationary Training (hereinafter referred to as the “Regulations”) define the general principles for the provision of training services and the organization of stationary training (hereinafter referred to as the “Training”) organized by OŚRODEK SZKOLENIOWO – WDROŻENIOWY MAREK SZARATA Limited Liability Company with its registered office in Bydgoszcz, ul. Piotrowskiego 11 lok. 36, 85-098 Bydgoszcz, with its registered office in Bydgoszcz, XIII Wydział Gospodarczy KRS pod numerem: 0001090009, NIP: 9671474250 and Łukasz Czubaszewski and Piotr Szałański, running a business on the basis of civil partnership agreements MASAŻTKANEKGŁĘBOKICH.PL Ł.Czubaszewski, P.Szałański S.C., ul. 27 Grudnia 9/8, 61-737 Poznań, NIP: 7831729919 (hereinafter collectively referred to as the “Organizer”).

2. Trainings are organized within the scope and dates specified in detail in the training offer available on the Organizer’s website – https://isdtmp.com/

§2
CONDITIONS OF PARTICIPATION

1. The basis for participation in the Training is to express willingness to participate in it by completing and sending to the Organizer the application form available on the Organizer’s website https://isdtmp.com/ and paying an advance payment within the time and amount set by the Organizer.

2. Application for participation referred to in §2 section 1 Regulations must be submitted at least 14 business days before the date of the planned training. Later registration is possible only after telephone agreement on the possibility of participating in the Training with the Organizer.

3. The Organizer reserves that the number of participants in the Training is limited and each time it results from the technical conditions of the place where the Training takes place, while ensuring the highest possible quality of the Training.

4. Qualification to the group of Training participants takes place in the order in which applications are received and advance payments are made. After closing the list of participants, it is possible to prepare a reserve list and in the event of resignation or removal from the list of a qualified Training participant, the Organizer will supplement the list of Training participants with people on the reserve list.

§ 3
TERMS OF PAYMENT

1. The amount of the training fee is consistent with the current offer posted on the Organizer’s website https://isdtmp.com/

2. Training prices include: participation in the training, a set of training materials, information materials, refreshments during the coffee break (including: coffee, tea, water) and a certificate, subject to §3 section 3 of the Regulations. The organizer does not provide transport and accommodation during the training. Training prices are given in Polish zlotys.

3. In the case of the Organizer’s flagship stationary training: “Deep Tissue Massage and myofascial release with palpation anatomy” lasting 64 hours, after making the advance payment referred to in §3 section. 4 of the Regulations, the participant will also receive access, on the Organizer’s VOD platform, to the recordings of the above-mentioned. training, within 7 days after the start of the course. After completing the course and paying the entire course fee, access to the above-mentioned recordings will be indefinite. In the event of cancellation of the course and/or failure to fully settle the amount due for the above-mentioned access course to the above-mentioned recordings will be blocked for the participant on the day the Organizer receives information from the participant about the cancellation of the course.

4. After receiving the application, the Training Organizer will send the participant confirmation of acceptance of the application via e-mail to the e-mail address provided by the participant.

5. In order to confirm the registration, the participant is obliged to pay an advance payment. The advance payment should be paid no later than 7 days from the date of application. Timely payment of the advance payment is a condition for entering and guaranteeing a place on the list of participants.

6. The Organizer undertakes to send details regarding the course and organization of the Training, together with the deadline for payment of the remaining Training price, by e-mail, no later than approximately two weeks before the start of the Training.

7. Payment for the purchased training is made in the form of:
a) fast online payments, via the PayU system, using available payment methods,
b) prepayment by transfer via PayPal or credit card or,
c) credit card prepayments via Stripe,
d) prepayment by transfer to the bank account of OŚRODEK SZKOLENIOWO – WDROŻENIOWY MAREK SZARATA Spółka z ograniczoną odpowiedzialnością, run by mBank, number: PL66 1140 2004 0000 3302 8465 4258. When making a transfer, the participant is obliged to provide the name and surname of the participant, city in the transfer title. where the training will take place and the name and date of the training.

8. The accounting document for the Training will be issued no later than 7 days from the date of payment of the entire Training price, with the sale date as of the date of completion of the training service. The accounting document will be sent to the e-mail address provided during registration for the training in electronic form (pdf file).

9. The Organizer reserves the right not to issue an invoice to an entity not registered in the Republic of Poland.

10. If the Training price is divided into installments, the participant is obliged to comply with the payment deadlines set by the Training Organizer. Detailed payment rules will be specified in individual training offers.

11. The payment date is the date of crediting the Organizer’s bank account.

§ 4
CANCELLATION OR CHANGE OF TRAINING CONDITIONS BY THE ORGANIZER

1. The organizer reserves the right to cancel the training up to 7 days before its start if the required number of participants is not reached.

2. In the event of cancellation of the training, the Organizer undertakes to notify the participants by phone and e-mail.

3. In the event of cancellation of the Training by the Organizer, participants have the right to:
a. Refund of the paid Training price, no later than 14 days from the date of receipt by the Organizer of an appropriate instruction from the Participant, to the bank account indicated by the Participant,
b. Crediting the paid price towards the price of the Training that will take place at a later date.

4. The Organizer reserves the right to change the price, date and program of the training, about which it will inform the participant at least 14 business days before the date of the Training. In such a case, the participant has the right to resign from the Training and refund the Training price, on the terms set out in §4 section. 3 of the Regulations.

5. In the event of cancellation or change of the date of the Training due to reasons beyond the Organizer’s control, in particular due to an epidemic, pandemic, state of emergency (state of natural disaster, state of emergency, martial law), weather conditions, problems with ground, land and sea transport, or due to other reasons beyond the control of the Organizer, then the participant is not entitled to a refund of the paid price and the Organizer undertakes to organize the Training on a new, changed date set by the Organizer.

6. In the situation specified in §4 section 5 of the Regulations, the Organizer undertakes to immediately notify the participant of the need to change the date of the Training, by phone and to the e-mail address provided by the participant.

7. The Organizer also reserves the right, in justified cases, such as illness or other random events, to change the person conducting the Training to another person with appropriate qualifications. In such a situation, the participant is not entitled to resign or reduce the price of the Training.

§ 5
WITHDRAWAL FROM TRAINING

1. The participant has the right to resign from participation in the Training at any time before its start, based on the participant’s written statement sent by e-mail. What part of the amount due for the training will be refunded depends on the date of informing the training organizer about the resignation from participation.

2. In the event of resignation referred to in §5 section 1 of the Regulations, the participant is entitled to a refund of the Training price, in accordance with the following rules:
a. in the event of cancellation at least one month before the date of the Training – the participant is entitled to a refund of the entire Training price,
b. in the event of cancellation at least two weeks before the date of the Training – the participant is entitled to a refund of 50% of the Training price,
c. in the case of resignation submitted later than two weeks before the date of the Training – the participant is not entitled to a refund of the Training price.

§ 6.
PASSING THE TRAINING

1. The condition for passing the Training and receiving the Certificate is participation in at least 80% of training classes and positive passing of the exam, if the training provides for such a form of passing.

2. Persons conducting the Training on behalf of the Organizer have the right to conduct tests to determine the knowledge and skills of participants.

3. In justified cases, the Organizer reserves the right not to issue a certificate, which does not result in the right to a refund of the Training price.

§ 7.
PERSONAL DATA PROTECTION

1. The administrator of participants’ personal data is the Organizer.

2. Detailed information regarding the processing of personal data by the Organizer as the personal data administrator, including other purposes and basis for data processing, as well as data recipients – can be found in the privacy policy available at https://isdtmp.com/privacy-policy/  – due to the principle of transparency contained in the General Regulation of the European Parliament and of the Council (EU) on data protection – “GDPR”.

3. The purpose of the Organizer’s processing of the participant’s data provided in the application form (name and surname, address, date of birth, telephone number, e-mail address and, alternatively, NIP) is the implementation of the concluded contract and the provision of services. The basis for the processing of personal data in this case is:
a. contract or actions taken at the participant’s request aimed at concluding it (Article 6(1)(b) of the GDPR),
b. legitimate interest pursued by the Organizer (Article 6(1)(f) of the GDPR) in the form of ensuring the possibility of pursuing any claims.

4. Providing data by the participant is voluntary, but at the same time necessary to conclude a contract with the Organizer. Failure to provide data will prevent the conclusion of this contract.

5. The participant’s data will be processed, depending on what is applicable in a given case and what will happen at the latest, until:
a. the contract concluded between the participant and the Organizer will cease to be valid;
b. the participant or the Organizer will no longer be able to pursue claims related to the concluded contract;
c. the participant’s objection to the processing of his or her personal data will be accepted – if the basis for data processing was the legitimate interest of the Organizer.

6. The participant has the right to request:
a. access to the content of your personal data, including obtaining a copy of your data (Article 15 of the GDPR or – if applicable – Article 13(1)(f) of the GDPR),
b. rectify your personal data (Article 16 of the GDPR),
c. delete your personal data (Article 17 of the GDPR),
d. limit the processing of your data (Article 18 of the GDPR),
e. transfer your personal data (Article 20 of the GDPR),
and:
f. object at any time to the processing of your data for reasons related to your particular situation – to the processing of personal data concerning you, based on Art. 6 section 1 letter f GDPR – i.e. on legitimate interests pursued by the administrator (Article 21(1) of the GDPR).

8. If the participant considers that his or her data is being processed illegally, he or she has the right to submit a complaint to the President of the Office for Personal Data Protection.

§ 8.
COMPLAINTS

1. The participant has the right to file a complaint against the Organizer no later than 14 days from the date of completion of the training.

2. Complaints and reservations should be reported:
a. sending or delivering the notice in person to the Organizer’s address;
b. by sending a notice to the Organizer’s e-mail address – szkolenia.mtg@gmail.com
c. by phone, on working days from Monday to Friday from 9:00 a.m. to 3:00 p.m. at: +48 662 310 264.

3. The complaint should include data enabling identification of the training participant, the subject of the complaint and requests related to the complaint. In the event of receiving an incomplete complaint, the Organizer will ask the participant to complete it, otherwise the complaint will not be considered.

4. The submitted complaint is considered by the Organizer within 14 days from the date of its proper receipt.

5. The person filing a complaint about the training service will be notified in writing about the acceptance or rejection of the complaint.

6. The written response of the Organizer to the submitted complaint is final and shall not be subject to reconsideration.

§ 9.
ADDITIONAL PROVISIONS

1. Registration on electronic media of the content and course of the Training by its participants is allowed only with the consent of the Organizer and the entity conducting the Training.

2. Training Participants are financially responsible for damage caused through their own fault during the Training.

3. Submitting the application form is tantamount to confirming that you have read and accepted the Regulations.
